ENROLLMENT AGREEMENT

The following agreements have been concluded.

Purchased Services and Fee:

• The course start date, class days, and hours are as specified in the packages indicated on the website. Changes may occur with the mutual agreement of the participants. 

• AGREEMENT

1.1  The subject of this agreement is the terms and conditions regarding the sale and performance of the German language course offered by the School, the course fees, the rules to be applied during the course, and the rights and obligations of the parties in case of disputes. 

1.2 The Student agrees to comply with the rules, guidelines, and procedures set forth in this agreement. 

1.3  The Registration Agreement shall enter into force upon the Student's submission of the registration application and receipt of confirmation of enrollment in the course schedule from the School.

• SERVICES 

2.1 The School provides training and support in German (or other languages) language skills (reading, writing, listening, speaking), exam preparation, learning strategies, and professional communication. 

2.2 The School may adjust class times and weekly schedules for pedagogical or organizational reasons; changes will be announced in a timely manner via LMS or email.

2.3. Content update: Course content may be regularly updated for didactic purposes; objectives and proficiency levels will remain unchanged.

• TUITION FEES 

3.1 Total course fee: {calculation-1}

3.2. A one-time registration processing fee of 50 euros is mandatory. This fee is non-refundable under any circumstances. 

3.3 The fee for each module (e.g., A1 (A1.1 + A1.2) is for 2 months) is collected before the respective module begins. The Student will be granted access to the class after paying the fee.  

3.4 If you sign a contract for multiple levels at the outset, you will receive a 5% discount for each level. For example: If the single price for A1 and A2 is EUR 800 each, and you purchase A2 along with A1, the total will be EUR 800 + EUR 760 (5% discount). We recommend selecting multiple levels. 

3.5 The School issues invoices with specific due dates. The Student shall make payments on time through the accepted channels/automated systems.

3.6 Non-payment/delay: If an unpaid invoice remains outstanding after the final reminder or for a longer period, the School may – provided there is no written payment agreement – terminate the registration or block access to the course. The School may claim its unpaid receivables and may seek assistance from third-party collection service providers. 

3.7  Corporate or public funding (e.g., job center/employment agency) may be involved; approval and payment are ultimately the responsibility of the Student. 

3.8. Textbooks and external exam costs are not included in the course fee. 

3.9 In the contract, fees for the selected levels are collected before the start of each respective level during the course. For example, if four levels between A1 and B2 are purchased, only the fee for Level A1 is charged before it begins. When multiple levels are purchased and the total amount is paid in a single payment, an additional 5% discount is granted on top of the existing offers.

Important Note for TL Payments: You can transfer the equivalent Turkish Lira amount by adding 3 EUR to your current installment amount. On the day you make the payment, you must calculate it using the current ‘Foreign Exchange Selling Rate’ by clicking the Central Bank's link (https://www.turkiye.gov.tr/doviz-kurlari). 

On the same day, you must send the transfer receipt to our Accounting Department's WhatsApp number (+49 6171 277 81 92). In all methods, please write the name of the course and the participant's name and surname in the description field.

3.11. Money-Back Guarantee Conditions:

1. Attendance Requirement: To be eligible for a refund under the satisfaction guarantee, the participant must have fully attended the classes on the first three days of the course. If valid excuses arise (such as illness, etc.) and are submitted to the management with documentation, make-up may be possible upon acceptance. Failure to meet these attendance requirements will result in the forfeiture of your right to a refund.  
2. Notification Period: Participants must notify the institution via email (courses@schopenhauer-sprachschule.com) within 7 calendar days from the first course day if the course does not meet expectations. Late notifications will not be considered. 
3. Consultation and Alternative Solutions: Upon receipt of a valid refund request, an online/in-person meeting will be arranged to assess the situation with the institution. A suitable alternative (e.g., change of class group, instructor, or program) will be offered. If a satisfactory alternative cannot be offered or is not accepted, the participant is entitled to a refund. 
4. Refund Procedure: Refunds will be made to the same account used for the original payment. Refunds will be processed within 4 weeks of approval. The institution will refund the full fee, excluding the registration processing fee, transfer charges, currency exchange differences, and bank deductions. 
5. Communication and Validity: All refund requests must be made in writing via email. Verbal or informal messages (e.g., via messaging apps) are not considered valid for refund processing.

 

4 WITHDRAWAL FROM THE COURSE AND EXCUSED ABSENCES

4.1  Upon the Student's written request, a leave of absence may be permitted at the School's sole discretion. Except in emergencies, all leaves must be requested and approved in writing in advance. Approval is not guaranteed; the School team will evaluate each request individually. 

4.2  A leave of absence will be granted without exception upon sufficient documented evidence of the following mitigating circumstances: The Student's own long-term illness, disability, or permanent health condition; pregnancy and mandatory postnatal rest; inability to continue due to severe psychological or psychiatric illness; death of a first-degree relative (mother, father, spouse, or child); serious illness or essential care requirements of a close family member; compulsory military service; admission to a formal educational institution creating a schedule conflict; court order or obligations imposed by an official government agency; or inability to continue due to changes in legal status, such as immigration, refugee status, or residence/visa issues.

4.3 Furthermore, the School reserves the right to evaluate and decide on leave requests for other documented reasons, including but not limited to: the Student's short-term illnesses; childcare or minor family health issues; schedule conflicts related to a child's education; personal reasons or family problems; change of residence or moving; changes in the Student's work schedule, workload, or professional responsibilities; new job opportunities; voluntary transfer; mandatory change of duties by the employer; temporary internet or technical hardware failures; lack of motivation; temporary financial difficulties; or general dissatisfaction. 

4.4 The return date from any approved leave must be mutually agreed upon in writing at the time the leave is granted. If the Student does not return to the program on the agreed-upon return date, their enrollment will be terminated. This situation does not entitle the Student to a refund. However, at the School's sole discretion, the Student may be offered a place in a subsequent group. 

4.5 The Student will be warned a maximum of two times for actions requiring withdrawal from the course and their defense will be requested. Their defense will be evaluated by the course management. If the Student is found to be at fault, the provisions for withdrawal from the course without excuse will apply. 

4.6 Course Withdrawal Fees and Refunds (excluding paragraph 3.11):

• If the participant’s reason is not considered reasonable, the full fee for the attended portion of the course is charged, and only half of the fee for the remaining period is collected.

• If the participant’s reason is considered reasonable, only a quarter of the fee for the remaining period is collected.

• If a refund is applicable, it will be processed within 4 weeks after approval. Except for the registration fee, transfer charges, exchange rate differences, and bank deductions, the fee will be refunded.

4.7 If the withdrawal request is deemed excused under the terms of this agreement, the Student's final financial obligation will be limited to the payment for the months attended plus one additional installment. The month in which the withdrawal occurs will be counted as a fully attended month. 

4.8 The provisions for withdrawal from the course without excuse will also apply to those who do not pay the course fee within the time specified in the contract. 

4.9 If participants withdraw from the course, whether justified or unjustified, a certificate of participation covering the modules for which they have attended enough to qualify for a certificate will be issued. 

4.10 If Students fail to meet the minimum 70% attendance requirement for the course, their registration at the School will be terminated without a refund. Their defense will be taken and evaluated by the course management. If the Student is found to be at fault, the provisions for withdrawal from the course without excuse will apply. 

• GENERAL PROVISIONS

5.1 If fewer than 7 participants register for a course, the institution reserves the right to shorten or cancel the course. 

5.2 Participants in the courses must be at least 16 years old. Minors cannot register independently. The registration form must be signed by a parent or legal guardian. 

5.3 No classes will be held on holidays announced by our institution. No make-up classes will be provided for classes that fall on these days. The course schedule has been created taking these holidays into account.

5.4 The teacher may arrange different times with the mutual consent of all Students. 

5.5 In case of irregular attendance, the course fee will not be refunded, nor will the right to join subsequent groups arise. Whether they can be included in subsequent groups within the scope of specified reasonable excuses (as stated in the relevant section) may be evaluated by the institution.  

5.6 Photographs and videos taken during on-site or online courses may be used in the institution's promotional materials or published on the internet. If you do not agree, you must indicate this on your registration form before the course begins. 

5.7 Class cancellation: In case of class cancellations originating from the School (teacher illness, etc.), a make-up class or an extension of the course duration is mandatory. 

5.8 The School reserves the right to reschedule the program start date if the planned number of Students is too low. In this case, the School will inform the Student as soon as possible.  

5.9  If participation in courses that have already started drops to a level that does not cover costs, the School may postpone/terminate the course. In this case, the Students' fees will be refunded proportionally. 

5.10 The School reserves the right to terminate the Student's education if the Student's progress is insufficient, the tuition fee specified herein is not paid, or this Registration Agreement and the applicable Policies and Code of Conduct are not adhered to.

5.11 Change of Instruction Mode

1. In-person courses may be temporarily switched to an online format in the event of extraordinary or force majeure circumstances (such as a pandemic, epidemic, natural disaster, war, restrictions or prohibitions imposed by public authorities, or situations that prevent safe transportation or participation).
2. If the instructor responsible for conducting the course experiences changes, suspension, or termination of residence or work permit status in the respective country, the institution reserves the right to appoint another qualified instructor or to temporarily continue the course online. Such circumstances do not constitute a breach of contract and do not entitle the participant to any refund or termination rights.
3. In such cases, the course content, duration, and quality will be maintained as closely as possible. The transition to online instruction does not constitute a breach of contract and does not entitle the participant to any refund, withdrawal, or termination rights.
4. When conditions return to normal, the course will resume in its in-person format from where it left off. The participant acknowledges and accepts this possible change in advance.
5. The participant is responsible for providing and maintaining the necessary technical equipment (computer, internet connection, camera, microphone, etc.) required to attend online classes. Access credentials to the online platform will be provided by the institution and must be kept confidential. The participant agrees not to share these credentials with any third party.
6. The course content may vary depending on the instructors' preferences regarding the order of topics.

 

6. CODE OF CONDUCT AND EDUCATION PLATFORM 

6.1 Making appropriate choices and taking personal responsibility for those choices is an important component of the teaching and learning process at the School.  

6.2 The Policies and Code of Conduct have been developed based on the belief that a dynamic educational environment creates opportunities for the development of responsible and productive individuals. In this environment, everyone is treated with respect and dignity, and decisions are based solely on what is best for the Students. All Students are obligated to comply with the Policies and Code of Conduct.

6.3 While the School believes there should be ample space for individual self-expression, it also believes that limitations must be imposed to maintain a safe and productive learning environment. Students are expected to behave responsibly and attend their classes. The School understands that situations may arise that prevent the Student from attending class. The Student is obligated to inform the instructor of the situation. We expect Students to attend classes on time. Additionally, Students must complete all assignments given by the instructor to maintain the flow and efficiency of the class.  

6.4 The Student must use online portals appropriately and in line with learning objectives. All Student activities may be monitored by administrators, provided that this monitoring complies with applicable laws.  

6.5 The School believes in embracing all diversity. Discrimination against anyone at the School based on race, gender, religion, political opinion, ethnicity, etc., will not be tolerated.  

6.6 Disrespect or lying in class or towards staff is prohibited. Students are prohibited from engaging in dishonest communication or behavior towards School staff and providing false information, and this will result in the Student's immediate removal from the program.

6.7  Internet and Campus LMS Policy 

1. Unacceptable use of the internet by Students includes, but is not limited to:
2. Sending or posting discriminatory, harassing, or threatening messages or images on the internet or via the School's email service 
   ii. Using computers to commit any type of fraud and/or software, film, or music piracy.
   iii. Stealing, using, or disclosing someone else's password without authorization. 
   iv. Sharing the School's copyrighted course materials or materials on its online portals constitutes a violation of intellectual property rights and is strictly prohibited.
   v. Downloading, copying, or pirating copyrighted or unauthorized software and electronic files. 
   vi. Unauthorized entry into unauthorized websites. 
   vii. Sending or posting defamatory information about the company, its products/services, employees, and/or customers. 
   viii. Introducing malware into the company network and/or compromising the security of the organization's electronic communication system. 
   ix. Sending or posting chain letters, solicitations, or advertisements not related to business purposes or activities. 
   x. Presenting personal opinions as those of the organization. 
3. If the Student is unsure what constitutes acceptable internet use, they should consult their supervisor for further information and clarification.
4. By signing the Registration Agreement, Students confirm that they understand and will comply with this internet usage policy. Students also understand that if they violate this internet usage policy, their access privileges may be revoked, and disciplinary action and/or appropriate legal proceedings may be taken.  
5. Campus LMS is an online platform used to enhance Students' learning experiences. Recorded class videos, books, and materials will be shared on this platform. 
6. Sharing login information with others is strictly prohibited.
   II. Downloading class videos is strictly prohibited.
   III. General copyright law protects all content developed by the School.
7. Illegally accessing or sharing this content with others will result in legal action and constitutes serious intellectual property damage. 
8. By signing the Registration Agreement, Students confirm that they understand and will comply with this Canvas LMS policy. Students also understand that if they violate this policy, their access privileges may be revoked, and disciplinary action and/or appropriate legal proceedings may be taken. 
9. Sharing, publishing, or otherwise disseminating the School's confidential materials, copyrighted course materials, trade secrets, or other proprietary information outside the School's ecosystem is prohibited.

• DATA PROTECTION CONSENT DECLARATION 

I permit and support the collection, use, and/or storage of my personal data by the assigned third parties, i.e., euroTech Study GmbH, for the following purposes:

1. To improve my employment chances  b. To provide to requesting government agencies c. Between assigned third parties and consumers  d. Accounting, tax law e. I consent to the sharing of my personal data with third-party institutions, persons, and programs for the institutional operation of the course.
2. I am aware that my personal data will be used only for the purposes stated above. If my data is used for purposes other than those stated above, a separate consent declaration will be requested from me.

Note: The processing of personal data pursuant to GDPR Article 9 (1) is based on GDPR Article 9 (2) (b). Furthermore, I am aware that pursuant to SGB II Article 61 (2) No. 1 or SGB III Article 318 (2) No. 1, I am obligated to inform the assigned third party about the success of the measure's implementation.

1. Rights of the data subject: information, correction, deletion, blocking, objection, complaint, portability: You have the right to request information about your personally stored data at any time. You can always make corrections. You can request the deletion and blocking of individual personal data.
2. Furthermore, you can exercise your right to object at any time without giving reasons and amend or completely revoke the given consent declaration with effect for the future. You can transmit your revocation request in person (in writing), by post, e-mail, or fax. You will not incur any costs other than the postage or transmission costs according to the existing basic tariffs. You have the right at any time to receive your personal data in a structured, common, and machine-readable format. Provided it is technically feasible, we will transfer this data to a third party at your request. You also have the option to lodge a complaint with a supervisory authority.
3. The storage of data ends when the purposes stated above are fulfilled. The final administrative processing can generally take place 2 years after the end of the measure/project. In some cases (accounting and tax law requirements), it may be necessary to store the required data for longer (up to 10 years).
4. I have fully read the above consent declaration, which is the legal basis for data processing for the purposes stated above, have noted its meaning, and I consent of my own free will:

This Agreement shall be governed by, construed, and enforced in accordance with the laws of the Federal Republic of Germany. If the Student is a consumer and has their habitual residence in another country, the Student shall continue to enjoy the protection afforded to them by provisions that cannot be derogated from by agreement under the law applicable in the country where the Customer has their habitual residence.

I have read and reviewed the School's Education Policies and Code of Conduct set forth in this Registration Agreement. I understand their content and agree to comply.

I understand that violation of the Code of Conduct and any behavior that the School, at its sole discretion, finds disruptive or inappropriate will lead to the termination of my contract. I understand that this is a legally binding contract. My signature below confirms that I have read, understood, and accepted my rights and responsibilities. Furthermore, I confirm that I understand the cancellation and refund policies and that I understand and accept these policies. 

The language of this Agreement is English. The School shall not be liable for any misunderstandings arising from the translation.
